WINNERS
Automatic draw will be done on April 7th, 2010 at around 1 pm at the Groupe Marcelle head office in Lachine. If a winner is a minor in her province or territory of residence as of Febryary 8th, 2010, the prize will be awarded to her parent or legal guardian. If Marcelle is unable to contact, after appropriate and reasonable efforts, one or more eligible Winners within three (3) business days, the Candidate’s participation in the Contest will be void and she will forfeit her prize. Marcelle will not be held responsible or liable should the attempts to contact an eligible Winner fail. Marcelle reserves the right, at its sole discretion, to award the prize to the next randomly drawn candidate without any further notice to the previously selected Eligible Winner. The alternate candidate shall be subjected to disqualification in the same manner.


PRIZES
Each Winner will receive a New•Age Anti-Wrinkle Make-up worth $22,95 CDN.
Prize will be distributed to Winners (or to their parent or legal guardian if minor) by mail. Prize cannot be delivered to a postal box). Marcelle will not be responsible for any charges incurred by Winner in collecting Prize in the event that the Prize is not deliverable to the Winners mailing address.

Prizes are not transferable and must be accepted as awarded with no substitutions, whether in cash or otherwise, except at the sole discretion of Marcelle. Marcelle reserves the right to substitute a prize of equal or greater monetary value if the prize, or a component of a prize, cannot be awarded as described in these Official Rules.


RELEASES
By entering the Contest, Candidates agree that Marcelle, and its respective affiliates, licensees, advertising and promotional agencies and judging organizations (the “Releasees”) are not in any way responsible or liable for damages, loss or injury resulting from participation in the Contest or the acceptance of the prize. By entering, each Candidate assumes sole liability for injuries including, without limitation, personal injuries and/or damage to property caused or claimed to be caused by participating in the Contest and/or the acceptance of the prize awarded. Before accepting the prize, Winners must sign a Release document to this effect. Such documents must be signed by the Candidate (or parent/legal guardian if Candidate is under the age of majority in their Province or Territory of residence as of February 8, 2010) and returned within 3 business days from the date indicated on the documents or the prize may be forfeited.

 
RIGHT TO TERMINATE
Marcelle reserves the right to modify or terminate the Contest without further notice or obligation to the Candidates if fraud, misconduct, human interference or technical failures or any other factor interferes with the proper conduct, security, or impartiality of the Contest as contemplated by these Official Rules.
 

LIMITATIONS OF LIABILITY
Without limiting the release provided in paragraph above, and for greater certainty, Releasees will not be liable for:
 
a) Any incomplete or inaccurate information, whether caused by Website users or by any equipment or programming associated with or utilized in Contest, or by any technical or human error which may occur in the processing of entries;
b) The theft, destruction or unauthorized access to, or alteration of, entries;
c) Any problems or technical malfunctions of any kind, including without limitation, hardware or software failures, lost or unavailable network connections, with telephone networks or lines, computer online systems, servers or providers, computer equipment, software, viruses or bugs;
d) Any failure of any entry to be received by Promoter, or any other party associated with the Contest, for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof, or postal delays;
e) Any damage to a Candidate’s or other person’s computer system occasioned by participation or downloading of materials from the Website; or
f) Lost, stolen, misdirected, postage due, illegible, delayed, damaged, destroyed, or otherwise unusable or ineligible entries which are void.
 

PERSONAL INFORMATION
By entering the Contest, Candidates consent to use of their personal information by Marcelle and its authorized agents for the purpose of administering the Contest and, if you are declared a Winner, to fulfill prizes. Your personal information will not otherwise be used for any other purpose, except as you otherwise consent or as required by law. 
 

MISCELLANEOUS
Marcelle reserves the right, at its sole discretion, to disqualify from this Contest, any individual that it finds or believes to be tampering with the entry process or the operation of the Contest or the Website; to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, intimidate or harass any other person. ANY ATTEMPT BY A CANDIDATE OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
